These Terms of Use apply to your use of tubeformsolutions.com, including its pages, blog, free calculators, charts, downloads and forms (the “Website”). The Website is operated by Tube Form Solutions, LLC, an Indiana limited liability company (“Tube Form Solutions”, “we”, “us” or “our”), 4221 Pine Creek Rd, Elkhart, Indiana 46516. By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1. Use of the Website

You may use the Website for lawful business and informational purposes. You agree not to:

  • copy, scrape or republish Website content, tools or data in bulk, or use automated means to access the Website in a way that places an unreasonable load on it;
  • attempt to gain unauthorized access to the Website, its systems or other users’ information;
  • upload or submit anything unlawful, harmful or that you do not have the right to share;

2. Free Calculators, Charts and Technical Content

The Website offers free calculators, charts, formulas, reports and articles, including tube bending, tube weight, pipe schedule, press brake tonnage, section modulus, XYZ to YBC, equipment lease and machine ROI tools (together, the “Tools”). The Tools are provided for general information and estimating only.

  • Results are estimates based on the values you enter and on general formulas and rules of thumb. They do not account for every material, tooling, machine or application condition.
  • The Tools and technical content are not engineering, financial, tax or legal advice. Confirm results with a test bend or trial, the machine and tooling manufacturer’s specifications, and a qualified engineer or advisor before relying on them.
  • Lease and ROI results are illustrations, not offers of credit or guarantees of savings. Actual terms depend on the lender and your circumstances.
  • You are responsible for decisions you make using the Tools, including machine selection, tooling, structural design and purchasing.

3. Product Information, Pricing and Quotes

Product descriptions, specifications, capacities and images are provided for information and may come from the manufacturers we represent. They may change without notice and may contain errors. Nothing on the Website is an offer to sell. Prices, lead times and availability are confirmed only in a written quotation from Tube Form Solutions, and all sales are governed by the terms and conditions stated in that quotation or order acknowledgment.

4. Information and Files You Submit

When you submit a form, download a report or request a quote, you agree that we may use the information to respond to you and to follow up about your request, as described in our Privacy Policy. If you upload part prints, drawings or other files, you confirm that you have the right to share them with us. We use them to evaluate and respond to your request and handle them with reasonable care. Please do not upload information that is subject to export controls (such as ITAR) or that you are not permitted to share without first contacting us. Submitting a request does not oblige us to provide a quote.

5. Intellectual Property

The Website and its content, including text, calculators and their outputs, charts, catalogs, photographs, graphics and logos, are owned by Tube Form Solutions or its licensors and are protected by copyright and other laws. You may view and print pages and use calculator reports for your own business purposes. You may not otherwise copy, modify, distribute or create derivative works from Website content without our written permission. SOCO, VLB, HSG, RAGOS and other product and company names are trademarks of their respective owners and are used to identify the products we supply.

The Website may link to websites operated by manufacturers and other third parties. We do not control those websites and are not responsible for their content or practices.

7. Disclaimer of Warranties

THE WEBSITE, THE TOOLS AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the Website will be uninterrupted or error-free. Warranties for equipment and services we sell are provided only in the applicable quotation, order documents or manufacturer warranty.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TUBE FORM SOLUTIONS, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PRODUCTION DOWNTIME OR SCRAP, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR THE TOOLS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE WEBSITE OR THE TOOLS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). This section does not limit liability that cannot be limited under applicable law, and it does not change the terms of any written sales agreement with us.

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of laws rules. Any dispute arising out of these Terms or the Website will be brought in the state or federal courts located in or serving Elkhart County, Indiana, and you consent to the jurisdiction of those courts.
